Terms & Conditions

1. Scope

These terms apply to all orders placed by consumers through seedbank.lu. By placing an order you accept these terms.

2. Age requirement

Our products are sold exclusively to persons aged 18 or older. By ordering, you confirm that you are at least 18 years old. We reserve the right to refuse or cancel any order where we have reason to believe the buyer is a minor.

3. Products & legality

We sell cannabis seeds. Home cultivation is legal for adults in Luxembourg (up to 4 plants per household) and in Germany (up to 3 plants per adult, Cannabis Act 2024). In other countries, our seeds are sold strictly as collectible genetic-preservation items, and germination or cultivation may be illegal. You are solely responsible for knowing and complying with the laws of your country before ordering. See our Age & Legality Policy.

4. Ordering & contract

Products in the cart are paid via Stripe's secure checkout. The purchase contract is concluded when we send you the order confirmation. We may decline orders to countries or in circumstances where sale would be unlawful.

5. Prices & payment

All prices are final prices in EUR. Shipping costs (see Shipping Policy) are displayed before payment. Payment is by credit/debit card via Stripe.

6. Delivery

We dispatch within 1–2 business days; delivery typically takes 2–5 business days within the EU. All shipments are tracked and sent in plain, discreet packaging.

7. Germination guarantee

Where cultivation is legal in your country of residence, we will replace seeds that fail to germinate free of charge, provided you notify us at info@seedbank.lu within 30 days of delivery. This guarantee does not apply where cultivation is not lawful for you.

8. Retention of title

Goods remain our property until paid in full.

9. Liability

We are liable without limitation for intent and gross negligence and for injury to life, body or health. For slight negligence, we are liable only for breach of essential contractual obligations, limited to the foreseeable, contract-typical damage. Your statutory rights as a consumer remain unaffected.

10. Governing law

These terms are governed by the law of the operator's seat. If you are a consumer resident in the EU, you additionally enjoy the protection of the mandatory provisions of the law of your country of residence.

11. Severability

If any provision of these terms is invalid, the remainder stays in effect.

What we process, and why

• Order & payment data — processed by Stripe Payments Europe Ltd when you check out (name, email, address, payment details). Legal basis: performance of contract (Art. 6(1)(b) GDPR). We never see or store your full card details.
• Server logs — our host Vercel Inc. (USA, certified under the EU-US Data Privacy Framework) processes IP addresses and technical request data to deliver and secure the site. Legal basis: legitimate interest (Art. 6(1)(f)).
• Newsletter — if you subscribe, your email address is processed via Formspree Inc. (USA) solely to send you product updates. Legal basis: consent (Art. 6(1)(a)); withdraw anytime via the unsubscribe link or by emailing us.
• Fonts — this site loads fonts from Google Fonts, which transmits your IP address to Google. Legal basis: legitimate interest in a consistent presentation; we plan to self-host fonts.
• Local storage — your cart contents, language and age confirmation are stored only in your own browser (localStorage). No tracking, no analytics, no advertising cookies, no profiling.

Retention

Order data is retained for the statutory commercial and tax retention periods. Newsletter data is kept until you unsubscribe. Server logs are retained briefly by our host for security purposes.

Your rights

You have the right to access, rectify and erase your data, to restrict or object to processing, to data portability, and to withdraw consent at any time with effect for the future. Contact info@seedbank.lu. You also have the right to lodge a complaint with your local data protection supervisory authority.

Shipping Policy

• Where we ship: Luxembourg, Germany, Netherlands, Spain, Austria, Portugal, Belgium, Italy, Ireland, Denmark, Sweden, Finland, Estonia, Latvia, Lithuania, Poland, Czechia, Slovenia, Slovakia, Croatia, Greece, Cyprus, Bulgaria, Romania, Hungary and Malta. We do not currently ship to France, Switzerland, Norway or outside the EU.
• Cost: flat €9.90 tracked shipping — free on orders over €50. The exact cost is always shown before you pay.
• Timing: dispatch within 1–2 business days; delivery typically 2–5 business days.
• Packaging: plain, discreet packaging with no reference to the contents.
• Your responsibility: by ordering, you confirm that receiving cannabis seeds is lawful at your delivery address.

Returns & Right of Withdrawal

As an EU consumer you have the right to withdraw from your purchase within 14 days of receiving the goods, without giving any reason.

How to withdraw

Email info@seedbank.lu with a clear statement of your decision to withdraw (you may use the model form below). Then return the goods to us within 14 days, unopened and in their original sealed packaging. You bear the direct cost of the return shipment.

We will refund all payments received from you, including standard delivery costs, within 14 days of receiving your notice (we may withhold the refund until we have received the goods back or proof of return), using the same payment method you used.

Note: seeds are perishable, sealed goods. The right of withdrawal expires for goods whose seal has been opened after delivery, for reasons of quality assurance.

Age & Legality Policy

18+ only. We sell exclusively to adults. Our checkout requires you to confirm your age, and we refuse or cancel any order where we believe the buyer is a minor.

Luxembourg: since 2023, adults may legally cultivate up to 4 cannabis plants per household at home, from seed. Cannabis seeds are legal to buy and sell.

Germany: under the Cannabis Act (CanG, April 2024), adults may cultivate up to 3 plants for personal use, and seeds may lawfully be obtained from EU member states.

Everywhere else: our seeds are sold as collectible genetic-preservation items. In many countries, germinating or cultivating cannabis seeds is a criminal offence. We do not encourage anyone to break the law of their country. Before ordering, verify what is legal where you live — you alone are responsible for compliance with your local laws.
